A rental agreement is one of the most important documents a landlord can have. This legally binding agreement clearly defines the terms and conditions between a landlord and a tenant. Thus a Texas rental lease agreement should be drafted by a credible legal professional who has enough knowledge in the legal limitations at the state and federal levels.

The terms of a leasing agreement

The lease agreement should clearly mention the names of every adult involved in the deal on both the tenant and the landlord side, and the adults should sign it as well. The document is thus binding towards everyone living under the roof and the owners of the home. Once the lease is signed, the tenant assumes legal ownership until their term is completed. The landlord has every right to cut short the lease time if the tenant breaches contract at any time.

If the rent is not paid on time, you are entitled to sue your tenants for full amount and even evict them in dire cases. The Texas laws pertaining to rental agreements do not specify the limit on the late fee.

You will have to obtain a security deposit of a suitable sum prior to your tenants moving in. This has to be returned to the tenants within 30 days of their leaving the property once their lease is up. You can however retain a part or full security deposit in order to fix some repairs or to accommodate the tenant’s failure to pay rent.

The Texas rental lease agreement is thus an important treaty between the landlord and the tenant as it helps give you both a common ground to stand on, especially in legal matters.
